City starts process to repeal Lucy annexation ordinance

The Millington Board of Mayor and Aldermen unanimously passed an ordinance on first reading last week that would repeal the ordinance designed to annex the Lucy community into the city.

Board members took the action during their Aug. 6 regular monthly meeting on a motion offered by Alderman Mike Caruthers and seconded by Alderman Don Lowry.

Interim Mayor Linda Carter said the repeal ordinance is scheduled for second reading during a special called meeting at 7 p.m. next Monday and third reading during another special meeting at 6 p.m. Aug. 27.

City Attorney Barbara Lapides recalled that, “just a few days” before the Lucy annexation was to go into effect on July 14, attorney Claiborne Ferguson filed a lawsuit challenging its “reasonableness.” Noting that the lawsuit effectively halted the annexation, she said Lucy residents were not part of Millington and were not eligible to vote in the Aug. 2 city elections.

“Assuming that [the repeal ordinance] passes on three readings,” Lapides said, “the Lucy annexation by ordinance will go away. And the lawsuit will actually be moot, because there won’t be any annexation by ordinance.”

But she said the board believes there are many people in the Lucy community who want to be annexed into the city. So, it has begun the process of allowing them to vote on that question.

“As part of that process,” she said, “the board will adopt a resolution calling for a referendum for annexation. There will be a public hearing, and then Lucy residents will have the right to vote on Nov. 6 whether they want to be part of the city of Millington.”

Noting that the board has adopted a Plan of Services for the Lucy community, Lapides said repeal of the annexation ordinance will not do away with that. She said the resolution calling for a referendum will reaffirm the Plan, which is in effect.

Carter noted that the board is scheduled to consider the resolution at its Sept. 4 regular monthly meeting.
