Unbelievable Malpractice

By David PeelDavid Peel

As an injury lawyer, I see some egregious medical malpractice cases, but this one is really unbelievable!
Imagine your sister needs a kidney. The waiting lists are long and many people die while awaiting an organ. But you are matched, and you and your family agree that you sacrificially undergo a painful procedure that has a significant healing time and leaves you with only one kidney for life.
But it is all worth it, right? Your sister can live a normal life because of your love and generosity, in spite of the pain and suffering, right?
Wrong.  The nurse threw away your precious donated kidney!
The University of Toledo Medical Center admits its nurse doing just that. You might sue. The family did.
That has not stopped the Medical Center from seeking to have the case thrown out and even denying that they were medically negligent! It leaves one wondering if they think that the medical standard of care is to throw a kidney away?
While she eventually was given another kidney, consider that the second donor kidney was delayed, she had the emotional scarring of the event and a subsequent extended wait, and the kidney was not from a family donor and thus far more likely to be rejected. Kidney donors are hard to find, so someone, somewhere might well die because the one they trashed was replaced with another.
Not to mention, a loving 20-year old brother had a totally unnecessary surgery and will live all his life in fear of any problem in his one remaining good kidney.
Did I mention this is a teaching hospital?
