PUBLIC NOTICE OF APPLICATIONS TO CHANGE BUSINESS NAME AND TRANSFER OWNERSHIP RESPONSIBILITY FOR CORRECTIVE ACTION PERMIT

PLEASE TAKE NOTICE that E.I. du Pont de Nemours and Company (DuPont) currently owns the real Property located at 2571 Fite Road, Memphis, Tennessee 38127 (Property). The Property is subject to Hazardous Waste Management Corrective Action Permit Number TNHW-143 (Permit), which was issued to DuPont effective September 30, 2009. The Permit requires certain actions for Solid Waste Management Units (SWMUs) and other Areas of Concern (AOCs) at the Property.

The business name for DuPont?s manufacturing operations at the Property was changed from DuPont to The Chemours Company FC, LLC (Chemours) on February 1, 2015. Despite this business name change, DuPont continues to officially own and operate the site and maintain Permit responsibilities through June 30, 2015. In accordance with Tennessee Department of Environment and Conservation (TDEC) Rule 0400-12-01-.07(9)(c)5(i), DuPont and Chemours collectively submitted a Class 1 Permit modification request to TDEC on January 5, 2015 to change the business name included in the site?s Permit from DuPont to Chemours.

Actual ownership of the Property and responsibility for the Permit is scheduled to be transferred from DuPont to Chemours on July 1, 2015. In accordance with TDEC Rule 0400-12-01-.07(9)(b)3(i), DuPont and Chemours collectively submitted a Class 11 Permit modification request to TDEC on March 5, 2015 to transfer ownership responsibility of the Permit from DuPont to Chemours. The transfer will not alter the requirements of the Permit, or otherwise reduce the capacity of the owner?s legal responsibility to protect human health and the environment. The required actions at the Property, which include institutional controls and monitoring of groundwater and surface water, have already been noticed to the public and approved by TDEC.

As specified by TDEC Rules 0400-12-01-.07(9)(c)5(i)(I)II and 0400-12-01-.07(9)(b)3(ii), notice of business name change and proposed ownership and operational control transfer of RCRA Permit responsibilities must be sent to all persons on the facility mailing list for the Property that is maintained by the Commissioner and to appropriate units of state and local government.

During the thirty (30) day public comment period following publication of this Notice, beginning March 12, 2015 and ending April 10, 2015, any interested person may submit comments on the Permit modifications by contacting Mr. Clayton Bullington, Division of Solid Waste Management Central Office, Tennessee Department of Environment and Conservation, William R. The permittee?s compliance history during the life of the Permit being modified is available from the Department contact person (Mr. Clayton Bullington).
