Commission approves Final Plat for Windstone Estates subdivision

The Millington Planning Commission has approved the Final Plat for construction of the  Windstone Estates residential subdivision north of Shipp Road and east of Highway 51.

Commission members took the action during their May 17 regular monthly meeting on a motion offered by Curtis Park and seconded by Vice Chairman Brett Morgan.

The motion was passed by six affirmative votes, with member Leanna Dagen absent.

PFMT Holding LLC owns a 14.92-acre tract zoned R-2, Medium-Density Residential, north of Shipp Road and desires to develop the site into a 39-lot subdivision.

Charles Goforth, planning consultant for the city, said a Homeowners Association must be established on the subdivision before the Final Plat is recorded, and “evidence” of it must be shown on the recorded plat.

So, when a piece of property is purchased, he said, the buyer will know that he is part of the association and subject to its rules regarding maintenance responsibilities.

Goforth said that, in R-2 zoning, each lot must be at least 6,500 square feet and have a minimum of 65 feet of frontage. But he noted that all but one of the lots in the subdivision will exceed 9,000 square feet.

He also said the subdivision will have a stormwater detention basin in open space that will be maintained by the Homeowners Association.

At its October 2020 meeting, the commission approved the Design Plat for the subdivision with the following conditions:

(1) The dimensions on the coves must be provided, with a 60-foot radius required.

(2) Street improvements will be required along the detention basin.

(3) The developer must agree to participate financially with the city in constructing a “connector” road from Shipp to Veterans Parkway by paying half of the construction cost.

(4) All the lots must have access only to the internal streets, not to Shipp Road.

At its Jan. 19 meeting, the commission unanimously approved the engineering plans for the subdivision.

Goforth noted that the subdivision was reduced from the originally proposed 40 lots to 39, because the detention basin will be enlarged.

At its March 8 regular monthly meeting, the Millington Board of Mayor and Aldermen unanimously adopted a resolution approving a Development Agreement for construction of the subdivision.

Goforth called the agreement “a little bit unusual,” because the planning staff had been working with the developers to get the connector road from Shipp to Veterans.

He said the developers were “setting up” a $137,910 “payment in lieu of” to help with the road construction, which the city would also require of the developer of the adjacent property.

While noting that the subdivision is in the North Creek Basin, Goforth said the fees for water and sewer there are $1,200 a lot. He also said the total fee due “upon signing” would be $112,200, and the bond on this project is $1,128,555.

At the May 17 commission meeting, Goforth said the contract had been approved, and work has already begun on the site.
